Explainer: Court ruling offers temporary relief for ADC as leadership dispute lingers

A recent judgment by Nigeria’s Supreme Court of Nigeria restoring the leadership of David Mark as national chairman of the African Democratic Congress (ADC) has provided short-term clarity—but stopped well short of resolving the party’s internal crisis.

In its unanimous decision, a five-member panel led by Justice Mohammed Lawal Garba set aside an earlier ruling by the Court of Appeal, faulting it for issuing orders after it had already dismissed the matter before it. The apex court nullified the directive maintaining the “status quo ante bellum,” describing it as procedurally flawed.

However, crucially, the court did not determine the substantive question of who legitimately leads the party. Instead, it ordered that the case return to the trial court for continuation of hearing—meaning the leadership dispute remains unresolved.

In practical terms, the ruling restores the Mark-led executive only on an interim basis, pending a final judgment. This leaves the party in a state of legal uncertainty, as decisions taken by the current leadership could still be overturned depending on the eventual outcome of the case.

The continued existence of rival factions within the ADC further complicates the situation, raising concerns about internal cohesion at a critical period ahead of Nigeria’s next general election cycle.

Pressure from electoral timetable

The uncertainty is compounded by a looming deadline set by the Independent National Electoral Commission (INEC), which requires political parties to submit their membership registers by 10 May in preparation for the 2027 elections.

With limited time remaining, the ADC faces both legal and logistical challenges. Disputes over the legitimacy of its leadership could affect the credibility of any membership list submitted to the electoral body.

There is also the risk of parallel submissions by rival factions, potentially triggering regulatory scrutiny or sanctions if inconsistencies arise over which list represents the authentic membership of the party.

A partial victory

While the Supreme Court’s decision strengthens the position of the Mark-led faction for now, analysts say it amounts to a procedural victory rather than a conclusive resolution.

Until the lower court delivers a final judgment—and the party resolves its internal divisions—the ADC remains in a fragile position, balancing legal uncertainty against pressing electoral obligations.
