Enugu court strikes out estate dispute case and awards ₦1m costs against complainant

An Enugu Magistrate Court has struck out criminal charges against a Lagos-based cleric, Pastor Basil Ogbuanu, and three others over a long-running dispute linked to a property at Independence Layout, Enugu, bringing an abrupt end to proceedings that had drawn public attention.

The court also ordered that the complainant, Mrs Patricia Nwobodo, wife of former Anambra State Governor Jim Nwobodo, pay ₦1 million in costs, citing what it described as her failure to pursue the case.

The ruling effectively halted a criminal trial that stemmed from a heated confrontation in early 2026, but it has left unresolved the wider underlying dispute over land ownership and development rights.

How the dispute began

The case originated from a disagreement over a parcel of land within a residential estate in Independence Layout, Enugu.

Pastor Ogbuanu, who operates Energy FM in Enugu, had been involved in development activities on the site when objections were raised by interests linked to the Nwobodo family. At the centre of the dispute was whether the construction activities were lawful and properly approved.

Both sides held conflicting claims: while Ogbuanu maintained that his actions were based on legitimate acquisition or allocation, the Nwobodo family insisted that parts of the development were unauthorised and required regulatory intervention.

What began as a civil disagreement over property rights soon escalated into a confrontation that drew in law enforcement.

The January confrontation

Tensions came to a head on 16 January 2026, when Mrs Patricia Nwobodo reportedly visited the estate accompanied by security personnel.

According to court documents and accounts presented during proceedings, the visit led to a confrontation involving estate occupants, security operatives and a police officer who was part of the team.

Allegations were made that individuals were briefly detained and that a police officer was assaulted during the incident. These claims formed the basis of the criminal charges later filed by the police.

The situation escalated quickly, resulting in arrests and the arraignment of Pastor Ogbuanu and three others on charges including conspiracy, unlawful detention and assault.

Court proceedings stall

The defendants were arraigned in January 2026 before the Enugu South Magisterial District Court. However, as proceedings continued, the case began to suffer repeated delays.

During hearings, the police prosecutor informed the court that the complainant had not been consistently available to support the prosecution. This meant witness statements could not be formally adopted and evidence could not be fully presented.

The defence team argued that the prosecution had effectively stalled and that the defendants who frequently travelled from outside Enugu were being subjected to unnecessary hardship due to repeated adjournments.

The ruling

Delivering judgment, Magistrate D.K. Ekoh struck out the charges, citing the absence of active prosecution and the inability of the complainant to sustain the case.

The court held that criminal proceedings could not continue in the absence of the necessary cooperation from the complainant and prosecution witnesses.

It also ordered that the defendants should not be re-arrested on the basis of the same complaint, effectively closing the criminal matter.

In addition, the court awarded ₦1 million in costs against Mrs Nwobodo, describing the situation as one in which a complaint had been initiated but not properly pursued.
